Interesting subject! I am involved in a class action lawsuit against Merck for taking a drug that gave me Osteonecrosis. I took Fosamax (as a "PREVENTATIVE) to getting Osteoporosis, only because I'm in menopause.
I got this "rotten jaw" syndrome. Been involved in this slow going law suit for several years.
Lawyers will take a suit, without up front money, if they think there's good chance they will win it. You have nothing to loose this way. It's just finding the right lawyer.
I wanted to write and tell you about my brother. I've been after him to get a lawyer.
He had cervical surgery a couple months ago and had four levels fused. I think it was C2-C6. To our surprise, what was supposed to be a simple overnight stay in the hospital, ended up with being admitted to ICU for a whole week...get this....for "observation".
Later, after WEEKS and WEEKS of running around to family doc, pulmonologists, etc. because they thought there was something wrong with his lungs. He was given X-rays, CT scans, MRI's and all to find that he had a collapsed lower lobe in his right lung. They treated him for pneumonia, asthma, infection.
What he HAS is a paralyzed diaphragm muscle...on the right side!! His breathing is VERY difficult, and just wears him out, because the Phrenic nerve was damaged or something, and his diaphragm isn't able to fill his lungs fully.
He finally went back to the surgeon who did his fusion who says it will probable get better. Now what "I" say, is how long should he wait for it to "get better"? I also think that the surgeon KNEW this was a problem immediately, and that's why he put him in the ICU for so long afterwords, but didn't tell my brother, or his family.
Your blood can become "toxic" if it's not picking up the O2 it needs. The surgeon told him to not go back to work (he's a maintenance manager, and does a lot of physical work) so he's looking to get on some degree of disability to make up for lack of work.
